- The Seller provides the following electronic services in the Shop free of charge:
- browsing the range of Goods;
- the basket and the Order form;
- Account: an optional Customer panel. The Shop currently does not offer account registration; Orders are placed without registration.
- The contract for the use of the basket and the Order form is concluded when the Customer starts using them, and ends when the Order is placed or the Customer leaves the Shop.
- The contract for maintaining an Account is concluded for an indefinite period when the Account is created. The Customer may terminate it at any time and without giving a reason by sending a request to delete the Account to biuro@opakuj.com. The Seller may terminate this contract with 14 days' notice if the Customer breaches these Terms and Conditions or the law, informing the Customer of this by e-mail together with the reasons.
- To use the Shop, you need: a device with internet access, an up-to-date web browser with JavaScript and cookies enabled, and an active e-mail address.
- The Customer may not transmit unlawful content via the Shop.
- Using the internet involves typical risks, such as malware, fake messages impersonating well-known companies or interception of data. The Shop uses an encrypted connection. The Customer should protect their Account password and not share it with others.
- The Seller never asks in an e-mail or text message for the Account password or for payment to an account other than the one given in § 7. If the Customer receives such a message or has doubts about the account number, they should call the Seller on +48 605 525 882 before paying.
§ 5. Goods and prices
- The key parameters of each item of Goods are given, e.g. film thickness in microns (μm) and roll dimensions.
- Prices of Goods are given in Polish zloty as net amounts, to which VAT at the rate of 23% is added. Prices of Goods do not include delivery costs, which are given in § 8.
- Before placing the Order, in its summary, the Customer sees the total gross amount payable, including VAT and the delivery cost. The amount shown at the time the Order is placed is binding. The Customer bears a higher pallet shipment cost only after expressly accepting it (§ 8(3)).
- Whenever a price reduction of Goods is announced, the Seller also states the lowest price of those Goods in the 30 days before the reduction was introduced.
- Photos show the Goods or their type. The shade of colour may differ slightly depending on screen settings.
- The Shop does not publish reviews of Goods.
- In addition to Goods, the Shop offers the Service “Training · Quality Inspections · Audits”. These Terms and Conditions apply to it, subject to the following:
- the price of the Service is given in its description; the scope, date and place of performance are agreed by the Seller with the Customer by e-mail or phone after the Order has been paid;
- the delivery costs and processing time in § 8 do not apply to the Service, as it is not shipped by a carrier;
- a Consumer and a Business Customer with consumer rights may withdraw from the contract for the provision of the Service within 14 days, on the terms set out in § 9. This right does not apply if the Seller has performed the Service in full with their express prior consent and after informing them that they will lose the right of withdrawal once the Service has been performed. If performance of the Service began at their express request before the withdrawal period expired and the Customer withdraws from the contract, they will pay for the services provided up to the time of withdrawal;
- complaints concerning the Service are handled, as appropriate, on the terms set out in § 10 (Consumer and Business Customer with consumer rights) or § 11 (Business Customer).
§ 6. Order and conclusion of the Contract
- An Order can be placed as a guest, without creating an Account.
- To place an Order, the Customer:
- adds the selected Goods to the basket;
- provides the details needed to process the Order: first name and surname, address, e-mail address and, optionally, phone number, company name and tax ID (NIP) (the NIP is needed to issue an invoice to a company);
- chooses the delivery and payment method;
- accepts these Terms and Conditions;
- clicks the button “Order with obligation to pay” or another button with an unambiguous meaning.
- Before clicking the button, the Customer sees an Order summary: the Goods and their quantity, prices, delivery cost, the total gross amount payable and the payment method.
- After placing the Order, the Customer receives an e-mail with the Order summary.
- The e-mail referred to in point 4 is the confirmation of acceptance of the Order. The Contract is concluded when the Customer receives it.
- For a pallet shipment, the delivery cost may turn out to be higher than the amount charged in the basket (heavier shipment or unusual delivery address). In that case § 8(3) applies: the Customer may accept the higher cost or cancel the Order free of charge, and without the Customer's express acceptance the Seller does not charge any additional amount.
- The Contract consists of: these Terms and Conditions, the description of the Goods and the Order confirmation. The Seller sends the Customer confirmation of the conclusion of the Contract together with the text of these Terms and Conditions by e-mail, at the latest at the time the Goods are delivered.
- If the data in the Order raises doubts (e.g. the delivery address is incomplete), the Seller contacts the Customer before processing begins.
§ 7. Payment and invoices
- The Customer pays for the Order using one of the methods available when placing the Order:
- online via the Przelewy24 service: by fast bank transfer, BLIK or payment card;
- by traditional bank transfer to the Seller's bank account: payee MOVIPAK Sp. z o.o., account number 31 2490 0005 0000 4530 3822 1501 (IBAN: PL31249000050000453038221501), payment reference: Order number.
- Online payments are handled by PayPro Spółka Akcyjna, based in Poznań, ul. Pastelowa 8, 60-198 Poznań, entered in the register of entrepreneurs of the National Court Register under KRS number 0000347935, NIP 7792369887, the operator of the Przelewy24 service.
- For online payment, the Customer pays immediately after placing the Order, on the Przelewy24 website to which the Shop redirects them.
- For a traditional bank transfer, the Order is payable in advance: after the Order is placed, the Seller sends the Customer a pro forma invoice by e-mail, which the Customer pays within 7 days of receipt. A Customer who has previously placed at least three Orders may be granted by the Seller deferred payment terms of 7 to 14 days from the invoice date; deferral requires individual agreement and confirmation by e-mail before processing of the Order begins, and without such confirmation payment in advance applies.
- Processing of the Order begins once the Seller receives payment confirmation from Przelewy24 or once the transfer is credited to the Seller's account.
- If the Customer does not pay on time, the Seller sends a payment reminder by e-mail and sets an additional, appropriate deadline. If this deadline passes without payment, the Seller may withdraw from the Contract.
- The Seller issues a VAT invoice using the details provided in the Order. To receive an invoice to a company, the Customer enters the NIP in the Order; it may not be possible to add the NIP after the purchase. Invoices are issued in accordance with the law, including, where the law requires it, in the National e-Invoicing System (KSeF).
- Detailed information on payment is given in the document “Delivery and payment”.
§ 8. Delivery and processing time
-
The Seller delivers Goods only within Poland. The Shop does not deliver abroad.
-
Delivery costs are given as net amounts, to which 23% VAT is added (gross amounts in brackets). Available delivery methods:
- small Goods (e.g. tapes and accessories): courier shipment: PLN 23.58 net (PLN 29.00 gross);
- one roll of film: courier shipment: PLN 185.00 net (PLN 227.55 gross);
- two or more rolls of film: pallet shipment: from PLN 250.00 net (from PLN 307.50 gross), on the terms set out in paragraph 3;
- personal collection: free of charge, on the terms set out in paragraph 8.
The delivery cost for the whole Order is calculated in the basket and shown in the Order summary before the Order is placed.
-
Pallet shipment:
- The basket charges PLN 250.00 net (PLN 307.50 gross). This is the delivery cost that the Customer accepts by placing the Order.
- If the shipment is heavier or the delivery address is unusual, the transport cost may be higher. In that case the Seller, promptly after the Order is placed and before processing begins, sends the Customer the amount of the delivery cost and the new total amount payable by e-mail.
- Within 7 days of receiving this message, the Customer may accept the new cost by replying to it by e-mail, or cancel the Order free of charge and without giving a reason. After acceptance, the Customer pays the difference or, if they have not yet paid, pays the new total amount.
- If the Customer cancels the Order or does not accept the new cost within the period set out in point 3, the Order is cancelled and the Contract expires. The Customer bears no costs as a result, and the Seller refunds all payments received promptly, and no later than within 14 days, in the manner described in § 9(7).
- Without the Customer's express acceptance, the Seller does not charge the higher delivery cost and does not begin processing the Order on the new terms. The rules in this paragraph do not limit the right to withdraw from the Contract described in § 9.
- Quotes for pallet shipments for Business Customers: § 11(7).
-
The Order processing time is the time from the payment being credited to the Seller's account to the shipment being handed over to the carrier. It is:
- small Goods sent by courier: 1 Business Day;
- pallet shipments: 2 Business Days;
- one roll of film sent by courier: 1–2 Business Days, depending on the time the Order is placed.
In the situation described in paragraph 3 point 2, the processing time runs from the crediting of the full amount after the Customer accepts the new cost.
-
The delivery time of the shipment depends on the carrier and is not included in the processing time. Unless the parties have agreed otherwise, the Seller delivers the Goods promptly, and no later than within 30 days of the conclusion of the Contract.
-
For a Consumer and a Business Customer with consumer rights, the risk of accidental loss of or damage to the Goods passes to the Customer when the Customer, or a person designated by them other than the carrier, takes possession of the Goods. Rules for Business Customers: § 11.
-
The Seller asks the Customer to check the shipment in the presence of the carrier and, in the event of damage, to draw up a damage report. For a Consumer and a Business Customer with consumer rights, this is only a request: the absence of a report does not take away their right to make a complaint.
-
Personal collection is free of charge and takes place at ul. Jutrzenki 9, 05-500 Józefosław, Monday to Friday from 8:00 to 16:00 and on Saturdays from 10:00 to 14:00. The Seller notifies the Customer by e-mail when the Goods are ready for collection.
§ 9. Withdrawal from the Contract: Consumer and Business Customer with consumer rights
- A Consumer and a Business Customer with consumer rights may withdraw from the Contract within 14 days without giving a reason and without incurring costs, except for the costs described in paragraphs 8 and 9.
- The 14-day period runs from the day on which the Customer, or a person designated by them other than the carrier, took possession of the Goods. If one Order covers several Goods delivered separately, the period runs from taking possession of the last of them.
- To withdraw from the Contract, it is enough to send the Seller a statement by e-mail to biuro@opakuj.com or by letter to ul. Jutrzenki 9, 05-500 Józefosław. The model form in Appendix No. 1 may be used, but this is not mandatory.
- To meet the deadline, it is enough to send the statement before it expires. The Seller promptly confirms receipt of the statement by e-mail.
- In the event of withdrawal, the Contract is deemed not to have been concluded.
- The Seller refunds all payments received from the Customer, including the cost of delivering the Goods to the Customer, promptly, and no later than within 14 days of receiving the statement of withdrawal. If the Customer chose a delivery method more expensive than the cheapest standard method offered by the Seller, the Seller does not refund the difference in price.
- The refund is made using the same payment method as the Customer used: for payment via Przelewy24, to the account or card used for payment, and for a traditional bank transfer, to the bank account from which the Customer paid, unless the Customer expressly agrees to a different refund method. The Customer bears no costs of the refund. The Seller may withhold the refund until it receives the Goods back or until the Customer provides proof that they have been sent back, whichever occurs first.
- The Customer sends the Goods back promptly, and no later than 14 days from the day of withdrawal from the Contract, to: MOVIPAK Sp. z o.o., ul. Jutrzenki 9, 05-500 Józefosław. To meet the deadline, it is enough to send the Goods back before it expires. The Customer bears the direct cost of returning the Goods.
- Some Goods, in particular rolls of film, including those shipped on a pallet, cannot be sent back by ordinary post due to their dimensions and weight. The Customer sends them back at their own expense, using a carrier of their choice. The estimated cost of returning a roll of film sent as a courier shipment is approximately PLN 200, and for a pallet shipment most often approximately PLN 320, usually in the range of PLN 260 to 390 (amounts given by the Seller based on carrier prices from September 2026). The actual cost depends on the price list of the chosen carrier, the weight and dimensions of the shipment and the place it is sent from.
- The Customer is liable for any reduction in the value of the Goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning. The Goods may be inspected and checked as they would be in a physical shop. However, for example, cutting off part of the roll or heat shrinking the film reduces the value of the Goods, which may reduce the amount refunded.
- The right to withdraw from the Contract does not apply to:
- Goods prepared to the Customer's individual order, i.e. manufactured to their specifications or serving to meet their individual needs. This applies in particular to film cut to a size specified by the Customer, which the Seller prepares to order for a surcharge of 10% of the price of the Goods;
- Goods which, after delivery, due to their nature, have become inseparably combined with other items, e.g. film heat shrunk onto the item being protected.
- A Business Customer (§ 2(6)) does not have the statutory right to withdraw from the Contract. Goods bought by a Business Customer may be returned only by agreement with the Seller.
§ 10. Lack of conformity of the Goods with the Contract: Consumer and Business Customer with consumer rights
- The Seller is liable to a Consumer and a Business Customer with consumer rights for any lack of conformity of the Goods with the Contract that existed at the time of delivery of the Goods and became apparent within 2 years of that time. If the lack of conformity becomes apparent within this period, it is presumed to have existed at the time of delivery, unless the Seller proves otherwise.
- The Goods conform to the Contract if, in particular, they match the description (e.g. thickness and dimensions), quantity and quality, have the characteristics typical of Goods of that kind and are fit for the purpose for which they are normally used, and also for any particular purpose of which the Customer informed the Seller at the latest when the Contract was concluded and which the Seller accepted.
- In the event of a lack of conformity, the Customer may request repair or replacement of the Goods. The Seller may replace the Goods instead of repairing them, or repair them instead of replacing them, if the method chosen by the Customer is impossible or would involve excessive costs. If both methods are impossible or would involve excessive costs, the Seller may refuse to bring the Goods into conformity with the Contract.
- Repair or replacement takes place within a reasonable time and without undue inconvenience to the Customer. All costs, including the costs of return shipping and collection of the Goods, are borne by the Seller. The Customer makes the Goods available, and the Seller collects them at its own expense.
- The Customer may submit a statement of price reduction or withdrawal from the Contract where:
- the Seller has refused to repair and replace the Goods or has not done so;
- the lack of conformity persists despite an attempt at repair or replacement;
- the lack of conformity is so significant that it justifies a price reduction or withdrawal from the Contract without prior repair or replacement;
- it is clear from the Seller's statement or from the circumstances that the Seller will not bring the Goods into conformity with the Contract within a reasonable time or without undue inconvenience to the Customer.
- The Customer may not withdraw from the Contract if the lack of conformity is insignificant; however, the lack of conformity is presumed to be significant. The reduced price must bear the same proportion to the Contract price as the value of the non-conforming Goods bears to the value of conforming Goods.
- The Seller refunds the amount due promptly, and no later than within 14 days of receiving the statement of price reduction or withdrawal from the Contract. In the event of withdrawal, the Customer promptly returns the Goods at the Seller's expense.
- A complaint can be made by e-mail to biuro@opakuj.com or by letter to the address given in § 9(8). It helps to include: contact details, the Order number, a description of the lack of conformity and the date it was noticed, your request and, if possible, photos. This information speeds up the handling of the complaint, but it is not a condition for the complaint to be accepted for consideration.
- The Seller responds to the complaint within 14 days of receiving it. If the Seller does not respond within this period, the complaint is deemed to have been accepted.
- Gas heat guns sold in the Shop are covered by a manufacturer's guarantee and a Seller's guarantee, both for a period of 12 months from the release of the Goods. The Customer submits claims under the Seller's guarantee to the Seller, using the contact details in § 3; claims under the manufacturer's guarantee are submitted as specified in the manufacturer's guarantee document. Other Goods are not covered by a separate guarantee unless the description of the Goods states otherwise. The guarantee does not limit the Customer's rights described in this paragraph.
§ 11. Provisions concerning Business Customers
The provisions of this paragraph apply only to Business Customers within the meaning of § 2(6). They do not apply to Consumers or to Business Customers with consumer rights.
- The Seller's liability under the statutory warranty for defects in the Goods is limited to 12 months from the date of release of the Goods. If the complaint is accepted, the Seller, at its discretion, replaces the Goods with Goods free from defects, removes the defect, reduces the price or, after the Goods are returned, refunds the price paid.
- The Business Customer checks the Goods promptly after receipt. Damage caused in transit is reported to the carrier on receipt, by drawing up a damage report, and to the Seller. Visible defects and missing items are reported to the Seller within 7 days of receipt of the Goods. After this period, rights under the statutory warranty relating to such defects expire.
- The risk of accidental loss of or damage to the Goods passes to the Business Customer when the Goods are handed over to the carrier.
- The Seller's liability to the Business Customer under the Contract is limited to the price of the Goods and the delivery cost of the given Order and does not include lost profits. This limitation does not apply to damage caused intentionally.
- The Seller responds to a Business Customer's complaint within 14 days. No response within this period does not mean that the complaint is accepted.
- Disputes between the Seller and a Business Customer are resolved by the court having jurisdiction over the Seller's registered office.
- For pallet shipments, the Seller may agree the delivery cost with the Business Customer by individual quote, instead of the cost given in § 8(2). The quote requires the Business Customer's acceptance before processing of the Order begins; if the Business Customer does not accept it, § 8(3)(4) applies accordingly.
§ 12. Complaints about the operation of the Shop
- Problems with the operation of the Shop (e.g. an error in the Order form, no confirmation e-mail) can be reported to biuro@opakuj.com, describing what the problem is.
- The Seller responds to such a report within 14 days of receiving it.
§ 13. Out-of-court dispute resolution
- A Consumer may use, among other things:
- free assistance from a municipal or district consumer ombudsman;
- mediation or a permanent consumer arbitration court at the provincial inspectorate of the Trade Inspection;
- assistance from the European Consumer Centre, in a dispute with the Seller where the Consumer lives in another European Union country.
- Information about these methods is available on the website of the Office of Competition and Consumer Protection: https://uokik.gov.pl.
- Use of out-of-court dispute resolution is voluntary and requires the consent of both parties.
§ 14. Personal data
The rules for processing personal data and using cookies are set out in the Shop Privacy Policy, available on the Shop website.
§ 15. Final provisions
- The Seller may amend these Terms and Conditions for important reasons, such as a change in the law, a change in payment or delivery methods or a change in the scope of the Shop's activity. The Seller publishes information about the amendment on the Shop website and sends it by e-mail to Account holders at least 14 days before the amendments take effect.
- Orders placed before an amendment to these Terms and Conditions are governed by the Terms and Conditions in force on the date the Order was placed.
- Contracts are governed by Polish law. If a Consumer has their habitual residence in another country, the choice of Polish law does not deprive them of the protection afforded by the mandatory provisions of that country's law.
- Disputes with Consumers and Business Customers with consumer rights are resolved by the court having jurisdiction under the general rules.
- These Terms and Conditions apply from the date indicated at their beginning.
- Appendix No. 1, the model withdrawal form, forms an integral part of these Terms and Conditions.
